VERDICT/SETTLEMENT
Facts/Liability:
This is a medical negligence claim brought by a 54-year old plaintiff. The plaintiff presented to the defendant cardiologist for diagnostic cardiac care and evaluation and treatment of his exertional dyspnea . While knowing that the plaintiff had a negative EKG, an equivocal stress test and a diagnosis of untreated severe iron deficiency anemia, which could be causing the plaintiff’s symptoms, the defendant performed an unnecessary, premature cardiac catheterization on the plaintiff. The plaintiff had severe anemia and a potential gastrointestinal bleed, and the defendant prevented the anemia from being treated and prevented a scheduled gastrointestinal work-up from being performed prior to performing an invasive cardiac catheterization. The defendant otherwise failed to appropriately manage the plaintiff’s cardiac care and cardiac catheterization. As a result of the defendant’s negligence, the plaintiff suffered a left-sided stroke as a direct result of this unnecessary and premature cardiac catheterization.
Injuries/Specials (if any): The plaintiff suffered significant permanent deficits from this left sided cerebrovascular event, including, but not limited to, symptomatic epilepsy, aphasia, apraxia , disorientation, confusion, and other physical and emotional pain and suffering. He has lost significant earnings and will never be able to return to his employment in his chosen profession as a lumber commodities broker. He has lost much enjoyment of life, lost opportunities, and incurred significant past and future medical expenses.
Verdict/Settlement: The parties reached a settlement for a confidential amount during jury deliberation, but after trial.
